In an argument over cigarettes, Fred Burke shoved and slapped his live-in girlfriend.

Originally brought up on domestic abuse charges (a felony, in Ohio), his charge has been reduced to simple assault (a misdemeanor).

Why? Ohio’s sweeping gay marriage ban forbids the legal recognition of unmarried couples of any kind, gay or straight. As a result, unmarried straight couples may assault each other … but a charge of domestic abuse may only be filed by married heterosexual couples.
